Welcome to Santa Fe Burrito Grill. These Terms of Service (“Terms”) govern your use of our website (santafeburritogrill.co) and our mobile application (collectively, the “Services”), operated by Santa Fe Burrito Grill (“we,” “us,” “our”).

Pricing and Taxes

All prices are in U.S. dollars and include applicable taxes unless otherwise stated. Prices may change without notice. The price you pay is the price displayed at the time you place your order.

Payment

Payment is processed at the time you place your order through Shift4 Payments. By providing payment information, you authorize us to charge the total amount including tax, delivery fees, and any tip. We do not store full credit card numbers; payment data is handled by our PCI-compliant payment processor.

Delivery

Delivery is provided by our partner DoorDash. Delivery fees, minimum order amounts, and service areas vary by location. Delivery times are estimates and not guarantees.

Pickup

Pickup orders are typically ready within the prep time displayed at checkout. Orders not picked up within a reasonable time may be discarded; we are not obligated to provide refunds for unclaimed orders.

Catering

Catering orders require a minimum of 24 hours advance notice. Catering orders are subject to availability and may be confirmed by phone before they are accepted.

4. Cancellations and Refunds

Cancellation by You

You may cancel an order before it has been picked up or before food preparation has started. Once we have begun preparing your order, cancellations may not be possible.

Cancellation by Us

We reserve the right to cancel orders for any reason, including:

  • Items unavailable.
  • Suspected fraud.
  • Inability to fulfill due to operational issues.

If we cancel your order, you will receive a full refund.

Refunds

Refunds are processed to the original payment method, typically within 5-10 business days. If you have a problem with your order (wrong item, food quality issue, etc.), please contact us at the location where you ordered or through customer support.

5. Loyalty Rewards Program

Our loyalty rewards program lets you earn points on qualifying purchases and redeem them for rewards. Program details:

  • Points are earned at a rate displayed in the app and may change at our discretion.
  • Points have no cash value and cannot be sold or transferred.
  • Points may expire if your account is inactive for an extended period.
  • We may modify or discontinue the rewards program at any time.
  • Fraudulent activity will result in forfeiture of points and account termination.

6. Promotional Codes

Promotional codes are subject to specific terms displayed at the time of issuance. Codes:

  • Cannot be combined with other promotions unless explicitly allowed.
  • Have expiration dates.
  • Are non-transferable and have no cash value.
  • May be limited to specific items, locations, or order types.
  • May be revoked if obtained through fraud or error.

7. Acceptable Use

You agree not to:

  • Use our Services for any illegal purpose.
  • Attempt to gain unauthorized access to our systems.
  • Interfere with the operation of our Services.
  • Submit false or fraudulent orders.
  • Harass our staff, drivers, or other users.
  • Reverse-engineer, decompile, or disassemble our app.
  • Scrape data from our Services without permission.

8. Intellectual Property

All content on our Services, including the Santa Fe Burrito Grill name, logo, menu, photographs, and app design, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

9. User Content

If you submit reviews, comments, or other content through our Services, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with our Services.

10. Third-Party Services

Our Services integrate with third-party services including Shift4 Payments, DoorDash, Apple, and Google. Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimers

Our Services are provided “as is” without warranties of any kind, express or implied. We do not warrant that our Services will be uninterrupted, error-free, or secure. Food allergens are listed on our menu; if you have severe allergies, please confirm with restaurant staff before ordering.

12. Limitation of Liability

To the maximum extent permitted by law, Santa Fe Burrito Grill, its officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability for any claim arising from these Terms or our Services will not exceed the amount you paid us in the 30 days before the claim arose.

You agree to indemnify and hold harmless Santa Fe Burrito Grill from any claims, damages, or expenses arising from your violation of these Terms or your misuse of our Services.
